Terms of Use - BulkTraffic.biz

ALL ORDERS THAT ARE PLACED THROUGH BulkTraffic.biz ARE SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS. BY PLACING AN ORDER IT IS UNDERSTOOD THAT YOU HAVE READ, COMPREHENDED AND AGREED WITH THESE TERMS.

These TERM and CONDITIONS are an agreement between you ("CUSTOMER, CLIENT") and BulkTraffic.biz ("us"). They should be read and understood.

The object of all sales are advertising services. They are mesured in number of visitors. The number of visitors is also called `credits`. Credits represent the number of visitors the Client can send using our software to his website. Credits are an intangible good. They quantify the service called 'Advertising space renting' or just 'Advertising'. The client, when purchasing will see as product description the traffic type, the number of credits and the total price. The client agrees that this description refers to advertising services.

All orders for amounts smaller than USD 10000 will be processed only trough the online credit card processor 2CheckOut.com. For amounts grater than USD 10000 only resellers can send payments, and only trough direct bank transfer. Non resellers are restricted to amounts smaller than USD 10000.

Payments in other currencies are accepted accordingly to this terms: 2CheckOut.com is the only responsible for currency conversion, for amounts smaller than USD 10000. For bank transfers, we accept only payments in USD and EUR, and the amount in EUR is to be calculated by our system using the official EUR/USD rate as displayed on x-rates.com and the USD price as displayed on our website.

Bank transfers are accepted only from resellers and for amounts grater than USD 10000. The payment process is similar, excepting the last page which needs to be printed and the instructions on it should be followed. We are willing to pay any transaction fees or taxes. Please instruct your bank to deduct any taxes from this amount. Usually the maximum fee for this type of transaction is ~ USD 30. Depending on customer`s payment history and fraud risk, the order paid trough bank transfer will be approved in maximum 3 business days, usually immediately.

All orders for amounts smaller than USD 10000 are processed by 2CheckOut.com, a leading payment gateway. All goods and services are provided by Web Heaven and sold by 2CheckOut.com Inc. (Ohio, USA). All matters related to the payment process are the responsibility of 2CheckOut.com. All Credit Card processing and money transaction will be done by the CUSTOMER under the legal terms and conditions of 2CheckOut.com. Any payment error, any payment related task is carried out by 2CheckOut.com, We should not be held responsible for any inconvenience or incident taking place during the payment process.

All traffic sent to the Customer is logged and verified only by BulkTraffic.biz. No other traffic log will be accepted when an legal issue regarding the amount of traffic sent is discussed.

In the event that the Client's site becomes unavailable for any reason ("server is down or unavailable, timed out, or shows to be active but with internal server errors, 404 errors and other types of common or uncommon errors associated with the Internet and its underlying infrastructure"), the Client will not hold BulkTraffic.biz or its Partner Sites responsible for these errors. All/Any traffic delivered to the Client's site during this down time will not be credited or refunded.

If a Client`s account is credited due to an authorized payment, the credits cannot be refunded. They can only be used with our software. Once the client received credits in his account he will not have the right to exchange them back into money, he can only exchange them into impressions of his website that visitors to our publisher network will see.

The client understands that if the visitor viewing the ad closes it before it finishes loading (due to network bandwidth, high impact graphics, animation or lack of interest on the visitors part, etc.), even if we did verified that the visitor is able to pop a window, IT WILL COUNT AS AN AD VIEW ON OUR SYSTEM, WE HAVE SENT YOUR SITE TO THE VISITOR AND HAVE THEREFORE FULFILLED OUR OBLIGATION. It is important to note that this scenario may not appear in your website statistics. BulkTraffic.biz cannot control the acts of the individuals viewing your site and will not be held responsible for these actions.

The client understands that we do not accept any credit refund requests. From the moment when he received his credits, even if he uses them inefficiently (eg. on misspelled URLs), and no traffic was sent to his website, we DO NOT issue a refund since we provide enough tools for testing our system or for testing the quality of our traffic. Credits can not be exchanged back into money except if we purposely delete / erase a client account, for inadequate use of credits, as explained below.

Client also understands that BulkTraffic.biz DOES NOT GUARANTEE SALES OR SIGNUPS AND WILL NOT ISSUE A REFUND IF NONE ARE ACHIEVED!

BulkTraffic.biz will not promote Spam, scam, hate, warez, hacking or any other site/offer that could be considered offensive to the most discriminate viewer with known intentions. All responsibility of the content of the websites promoted goes to the client. We will not accept adult websites to be promoted trough our system. any pornographic or erotic websites are forbidden.

We reserve the right of deleting inappropriate campaigns in terms of content of the page displayed to the visitors. We will call this "abuses". When we will delete an inappropriate campaign, all the remaining credits will be returned to the customer account but a certain amount will be held to prevent further abuses as 'abuse tax'. For each abuse the amount of credits taken is calculated as follows:
- For ADULT/pornographic/erotic content: 100 multiplied 4 times with the number of abuses;
- For websites with POPUPS, POPUNDERS or EXIT WINDOWS: 150 credits multiplied 4 times with the number of abuses;

If the client promotes websites that spread any kind of viruses, exploits, worms, etc we reserve the right to terminate, erase the client`s account, without any kind of warning. The remaining credits will be returned to the customer converted back to money at the apropriate conversion rate, as displayed on our price list, but any taxes or fees implied by this transaction will be held from this amount plus a 50 USD fee for our service. No other refunds or credits to many exchanges are accepted.

During registration, BulkTraffic.biz will gather personal information such as your name and email address, your street address, billing information, and the URL of your web site. This information is used solely by BulkTraffic.biz to provide services to you or to assist you in navigating the system by automatically filling in certain forms with your information so that you don't have to continually re-enter it. Once you register you are no longer anonymous - you have a username and are able to take full advantage of the many offerings of BulkTraffic.biz.

In addition to registration we may ask you for personal information at other times, including (but not limited to) when you place listings or take advantage of the other features of BulkTraffic.biz. If you contact us, we may keep a record of that correspondence. Every page within BulkTraffic.biz includes a link to this Privacy Policy.

As a general rule, we will not disclose any of your personally identifiable information except when we have your permission or under special circumstances, such as when we believe in good faith that the law requires it or under the circumstances described below.

BulkTraffic.biz may disclose account information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating the Terms of Use or may be causing injury to or interference with (either intentionally or unintentionally) the rights or property of the website, other users of the website, or anyone else that could be harmed by such activities. BulkTraffic.biz may disclose or access account information when we believe in good faith that the law requires it and for administrative and other purposes that we deem necessary to maintain, service, and improve our products and services.

We will provide you with the means to ensure that your personal information is correct and current. You may edit or delete your user profile at any time once you are logged in. Once you have logged onto the system during a given session, wherever you go on BulkTraffic.biz, your information will stay with you until or unless you click on the "Log Out " link.

If you are a previously registered user and you have lost or forgotten your password, you may obtain it by email by using our "Forgot Password" feature. Click the button on any login page to request that your password be emailed to you. We cannot provide your password by any other means.

Your BulkTraffic.biz account can be deleted, but doing so will result in not being able to access any of the features of the program that require user registration.

Other than the administrator of the BulkTraffic.biz or other authorized personnel of the website, you are the only person who has access to your personal information. Your user registration is password-protected to prevent unauthorized access.

We recommend that you do not divulge your password to anyone. We will never ask you for your password in an unsolicited phone call or in an unsolicited email. As an extra security precaution, you may want to logoff once you have completed a session in the system. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or Internet cafe.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, cannot ensure or warrant the security of any information you transmit to us or from our online services, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems.
